On November 28, 2014 the Government of Canada created two new Caregiver Classes:
- Caring for Children Class and
- Caring for People with High Medical Needs Class
Further, the Government of Canada has restricted the intake of all current live-in caregiver permanent residence applications unless the live-in caregiver has a work permit associated with a Labour Market Impact Assessment (“LMIA”) requested from Service Canada on or before November 28, 2014. For caregivers that have a work permit that was secured with a positive LMIA and that LMIA was requested from Service Canada on or before November 28, 2014, and they meet the requirements to apply for permanent residency, then Citizenship and Immigration Canada will accept their application for permanent residency.
Caring for Children Class
For all Caregivers looking after children who don’t meet requirements indicated above and/or who are already in Canada seeking a new LMIA requested after November 28, 2014 the eligibility requirements are:
- Have acquired, within the four years of applying for permanent residence, at least two years of full-time work experience in Canada as a Home Child Care Provider, within the meaning of that occupation as set out in National Occupational Classification code 4411, other than experience as a foster parent;
- Meet the employment requirements of being a Home Child Care Provider;
- Have attained a level of proficiency of at least benchmark 5 in English or French demonstrated by the results of a language exam;
- Have obtained either a Canadian educational credential of at least one year of post-secondary studies, or a foreign equivalent as demonstrated through an educational credential assessment; and
- They intend to reside in a province other than Quebec.
Caring for People with High Medical Needs Class
The eligibility requirements for applying for permanent residency under this class include:
- Have acquired, within the four years of applying for permanent residence, at least two years of full-time work experience in Canada in one of the following occupations:
- Registered Nurse or Registered Psychiatric Nurse within the meaning of National Occupational Classification code 3012;
- Licensed Practical Nurse within the meaning of National Occupational Classification code 3233;
- Nurse Aide, Orderly, or Patient Service Associate within the meaning of National Occupational Classification code 3413; or
- Home Support Worker, but not Housekeeper, within the meaning of National Occupational Classification 4412.
- Meet the employment requirements of their respective occupation;
- For Registered Nurses or Psychiatric Nurses, have attained a level of proficiency of benchmark 7 in English or French demonstrated by the results of a language exam. For remaining professions have attained benchmark 5;
- Have obtained either a Canadian educational credential of at least one year of post-secondary studies, or a foreign equivalent as demonstrated through an educational credential assessment; and
- They intend to reside in a province other than Quebec.
For both Caregiver Classes eligible full-time work experience must not include any periods during which the foreign national was engaged in full-time study or was self-employed and must involve work that was authorized under a work permit.
